2. Booking and Payment
2.1 How to Book
All sessions and programmes are booked directly with us. You can make a booking by contacting us via email at gurinder@gurindersandhu.coach or through any enquiry form on our website. A booking is confirmed only when we send you written confirmation (including confirmation by email).
2.2 What We Offer
Services covered by these terms include, but are not limited to:
- One-to-one coaching and personal training programmes
- Coaching and personal training sessions (in person or remote)
2.3 Payment
We will confirm accepted payment methods at the point of booking. Payment is due in advance of sessions or programmes unless we have agreed otherwise with you in writing. We reserve the right to withhold or cancel a confirmed session if payment has not been received by the agreed date.
3. Cancellation, Late Arrival, and No-Shows
3.1 Cancellation Notice
You may cancel or reschedule a session free of charge if you give us at least 24 hours' notice before the scheduled start time. Notice must be given by email to gurinder@gurindersandhu.coach or by any other written method we have agreed with you.
3.2 Late Cancellations
If you cancel with less than 24 hours' notice, we will charge the full session fee. No credit or refund will be issued for that session.
3.3 Late Arrivals
If you arrive late to a session, the session will still end at its originally scheduled time. You will be charged for the full session regardless of how much time remains. We will not carry over unused time to a future session.
3.4 No-Shows
If you do not attend a session and have not contacted us to cancel or reschedule, we treat this as a no-show. The full session fee is charged, and no credit or refund is issued.
3.5 Cancellation by Us
We will give you as much notice as possible if we need to cancel or reschedule a session. If we cancel a confirmed session and cannot offer you a suitable alternative time, any prepaid fee for that specific session will be credited to your account or refunded at our discretion. We are not liable for any other costs you incur as a result of our cancellation.
4. Refunds
All sales are final. We do not offer refunds on sessions, programmes, or any other services once payment has been made. This applies whether you have used some, all, or none of the sessions and other services in a programme.
We recognise this is a firm position, and we encourage you to ask any questions you have about our services before you pay. If you have a concern about a charge, please contact us at gurinder@gurindersandhu.coach and we will discuss it with you in good faith.
Nothing in this section affects your statutory rights under UK consumer law, including any rights you may have under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
5. Programme and Session Rules
5.1 Validity
Programmes start from the date the Client Agreement is signed and expire at the end of their stated duration.
Any sessions or services remaining unused upon completion of the programme are forfeited and cannot be used beyond the programme expiry date.
5.2 Transferability
Programmes are personal to you. You may not transfer unused sessions within a programme to another person unless we have agreed to this in writing.
5.3 Pausing a Programme
If you need to pause your training for medical or other significant reasons, please contact us. We will consider requests to pause a programme on a case-by-case basis, though we are not obliged to agree to a pause.
6. Health, Safety, and Your Fitness to Participate
6.1 Health Questionnaire (PAR-Q)
Before your first session, you must complete a Physical Activity Readiness Questionnaire (PAR-Q) and any other health screening form we ask you to complete. Completion of this questionnaire is a prerequisite for participating in any session. We will not begin training with you until we have received a completed form.
6.2 Your Responsibility to Disclose
You are responsible for telling us, before each session and on an ongoing basis, about:
- Any injury, illness, or physical condition that may affect your ability to exercise safely
- Any medication you are taking that could affect your response to exercise
- Any change in your health since your last session
If you are in any doubt about whether it is safe for you to exercise, you should consult a qualified medical professional before training with us.
6.3 Our Right to Refuse or Stop a Session
We reserve the right to refuse to start a session, or to stop a session already in progress, if we reasonably believe that continuing would put your health or safety at risk. If we do this, the session fee remains payable in full. We will always act in good faith when making this judgment.
6.4 Assumption of Risk
Exercise carries inherent physical risk. By participating in sessions, you acknowledge that you are voluntarily taking part and that you have disclosed all relevant health information to us. This does not affect our liability for negligence as set out in Section 9.
7. Code of Conduct
We expect all clients to behave in a way that is respectful to us, to other clients, and to any venue we use. Specifically, you agree to:
- Arrive on time and ready to train
- Treat our coach and any other clients with courtesy and respect
- Follow all reasonable instructions given by the coach during a session
- Respect the rules of any venue in which sessions take place
- Not attend a session if you are unwell in a way that could put others at risk
- Not behave in a way that is abusive, threatening, or discriminatory
We reserve the right to terminate a session immediately, and to end our working relationship with you, if you breach this code of conduct. In the event of termination for conduct reasons, no refund will be issued for any unused sessions or prepaid fees.
8. Price Changes
We will give you at least 30 days' written notice before any change to our prices takes effect. Notice will be given by email to the address you have provided us.
Any session or programme you have already paid for at the time a price change is announced will be honoured at the price you paid. The new price will apply only to bookings or purchases made after the change takes effect.
9. Liability
9.1 What We Are Not Liable For
To the fullest extent permitted by UK law, we are not liable for:
- Any indirect or consequential loss you suffer as a result of our services or any failure to provide them
- Loss of income, loss of opportunity, or any other financial loss beyond the direct fees you have paid us
- Loss or damage to your personal property at any training venue
9.2 What We Cannot Exclude
Nothing in these terms limits or excludes our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded or limited under UK law, including your rights under the Consumer Rights Act 2015
9.3 Our Reasonable Precautions
We hold appropriate professional qualifications and insurance for the services we provide. We take reasonable steps to ensure that sessions are delivered safely and to a professional standard.
10. Intellectual Property
All content on our website (gurindersandhu.com) and any programme materials, training plans, or other content we provide to you as part of our services is owned by EvolveThrive Ltd or licensed to us. You may use materials we share with you for your own personal training purposes only. You may not reproduce, share, sell, or distribute any of our content without our prior written permission.
11. Changes to These Terms
We may update these terms from time to time. When we do, we will update the "Last updated" date at the bottom of this page. If we make a significant change that affects your existing bookings or ongoing package, we will notify you by email at least 14 days before the change takes effect. Continued use of our services after that date means you accept the updated terms.
If you do not accept a significant change, you may stop using our services. Any programmes or sessions you have already paid for will be honoured under the terms in place at the time of payment.
12. Governing Law
These terms are governed by the law of England and Wales. Any dispute arising from or relating to these terms or our services will be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer, this does not affect any mandatory legal protections you have under the law of the country in which you are resident.
